All services rendered by or on behalf of Cheap-Flight.co.za (‘Cheap-Flight.co.za’) to the Client/s are subject to the terms and conditions (‘the Conditions’) set out below. Cheap-Flight.co.za, located at 11 Scafell Road, Floracliffe, Johannesburg, Gauteng, South Africa, 1709. The following Terms and Conditions should be read and understood prior to confirming your travel. Do not confirm any booking unless you understand and agree with the following terms and conditions.

Covid-19 Disclaimer

By proceeding to book You agree and accept the Terms and Conditions of the Cheap-Flight.co.za Website and its travel Partners. You further acknowledge that Cheap-Flight.co.za operates as a reseller of flights and all content that appears on our website is sourced from a GDS (Global Distribution Service) or from our Travel Partners directly via an API. Whilst every effort is made to ensure that systems are updated to take into account any travel restrictions that may exist at the time of booking, it may be possible that there is a delay in the GDS or Airline system updating to accommodate all travel restrictions that may be imposed. By booking the selected flight with us, you confirm that you have checked that there are no travel restrictions, in both your country of departure, transit and arrival, that may affect your booking and that you have satisfied yourself on behalf of all travellers in the booking that you can proceed with the booking. Please also check the entry requirements of your destination country, as a quarantine period or testing might be a requirement when flying in from South Africa.

Cheap-Flight.co.za cannot be held liable for any operational changes, cancellations or consequential damages incurred by you, or any passenger in the booking, in the event that flights are not able to operate as planned, including any disruptions, cancellations or changes to planned schedules. Please note that in the event that a flight is disrupted or cancelled due to travel restrictions being imposed that each airline will have their own policy in this regard, which will apply to your booking.

Services rendered by Cheap-Flight.co.za

Cheap-Flight.co.za renders the service of hosting an online search and booking website, with its primary focus on the travel, flights, car rentals and accommodation industries (‘the Services’) pursuant to which the general public shall

have access to the website,
be entitled to set certain travel, accommodation and/or other service criteria based on information gleaned from the internet,
request quotations and
be entitled to confirm bookings and place reservations relating to travel, accommodation and/or other service requirements
For the avoidance of doubt, the services do not include any advisory or consultancy services.

Third Party Service Providers

Cheap-Flight.co.za provides Clients with the services either itself or acting on behalf of Principals engaged in or associated with the travel and/or accommodation industries, such as airlines, hotels and/or other service providers or suppliers (collectively referred to as ‘the Principal’). Cheap-Flight.co.za represents the Principal as agents only AND ACCORDINGLY ACCEPTS NO LIABILITY for any loss, damage (including loss of profits or consequential or special damages), injury, illness, harm or death (except if such loss or damage arises from the gross negligence or wilful misconduct of Cheap-Flight.co.za or any person acting for or controlled by Cheap-Flight.co.za), which any Client may suffer as a result of any act or omission on the part of or the failure of the Principal to fulfil their obligations, whether in relation to travel arrangements, accommodation or otherwise.

When you make a booking with us, you acknowledge and agree that we act only as an agent for the third party service provider, which is solely responsible to provide you with the travel or service which you have booked. The contract in use by the Principal (which is often constituted by the ticket issued by the Principal), shall constitute the sole contract between the Principal and the Client and any RIGHT OF RECOURSE the Client may have, will be solely against the Principal. Cheap-Flight.co.za shall, as soon as possible after the confirmation of the Client’s booking, provide to the Client the identity of the Principal.By making a booking you agree to have your contact details shared with the Principal in order to facilitate your booking. In the event that you prefer not to have your contact details shared with the Principal this needs to be explicitly requested by you by completing a contact form once you have completed your booking.

Please be advised that when booking a travel package with Cheap-Flight.co.za, either online, or with a Live Agent, it is the Passenger’s responsibility to ensure that they have familiarized themselves with all terms and conditions that are applicable to their booking, which may include air, rail, bus, transport services suppliers, hotel and tour operators, etc. Cheap-Flight.co.za has a trade relationship with a number of preferred third party travel providers and the provider’s terms and conditions are available to the Passenger here:

Please note that this list is not exhaustive and should the specific terms and conditions of the Service Provider not be listed, please ensure that you make an effort to locate them and peruse them before making your booking.

In the instance where a unique travel package has been requested and built specifically for a Passenger, Cheap-Flight.co.za does not warrant or guarantee the service or the refundability of the booking. It is the Passenger’s responsibility to confirm that he/she has satisfied him/herself as to the terms and conditions of all suppliers related to that specific booking.

From time to time Cheap-Flight.co.za may, together with a partner, offer exclusive promotional deals, which will only be available to a select group of people based on qualifying criteria. In this instance specific terms and conditions may apply, which will be made known to you.

Please be advised that when making an online booking it is not possible to display the fare conditions of a particular ticket. Should you wish to inquire about this before confirming a booking you should contact a Live Agent for assistance.

Please be aware that Third Party Service Providers (Airlines) may charge extra for certain items such as: seating, special meal requests or printing boarding passes. This is subject to change without notice to you. By agreeing to these terms and conditions upon making your booking you agree to accept this condition.

It is the Client’s responsibility to familiarise themselves with such terms and conditions (‘the Principal’s Conditions’).

The specific airline’s or third parties’ terms and conditions may apply.

Destination Selection

The Client ACKNOWLEDGES that it has selected the itinerary and destination(s) constituting the Booking based on information gleaned from the internet. He/she ALSO ACKNOWLEDGES that the internet Booking has been compiled and is managed and updated by the Principal, and that Cheap-Flight.co.za has no control over information compiled by the Principal. Accordingly SOUTH-AFRICA.NET CANNOT AND DOES NOT GUARANTEE that the itinerary and/or any destinations will comply in whole or in part with those advertised on the internet by or on behalf of the Principal. Any right of recourse in that regard will be against the Principal. in addition to the above Cheap-Flight.co.za cannot be held liable for incorrect availability being displayed by the Principal and we cannot be held liable if the seats selected are not available. Or the accommodation is not available or the services are not available.

Insurance

It is STRONGLY ADVISED that all Clients take out adequate insurance cover in order to cover instances such as cancellation due to illness or injury, personal accident and personal liability, loss of or damage to baggage and sports equipment. (Note that this is not an exhaustive list). Cheap-Flight.co.za will NOT BE RESPONSIBLE OR LIABLE if the Client fails to take adequate insurance cover. It shall not be obligatory upon Cheap-Flight.co.za to effect insurance for the Client (since this service does not fall within the scope of the Services) except upon detailed instructions given in writing by the Client. All insurance effected by Cheap-Flight.co.za pursuant to such instruction will be subject to such exceptions and conditions as may be imposed by the insurance company or underwriters accepting the risk. Cheap-Flight.co.za shall NOT BE OBLIGED to obtain separate cover for any risks so excluded. Should the insurers dispute their liability for any reason, the Client will have recourse against the insurers only. Please note that various credit card companies offer limited levels of travel insurance, which in Cheap-Flight.co.za’s view may not be sufficient cover for international travel. The CLIENT IS ADVISED to check with their respective credit card companies in order to obtain the specific details of the cover offered, and determine whether this is sufficient for the Client’s requirements.

Passports, Visas & Health

It is ENTIRELY THE CLIENT’S RESPONSIBILITY to ensure that all passports and visas are current, valid, obtained on time, have sufficient blank pages, will be valid for six months after return to their home country and that any vaccinations, inoculations, prophylactic (e.g. for malaria) and the like, where required, have been obtained. The Client is STRONGLY ADVISED to check the relevant requirements for their destination and any transit countries before travelling.

Before booking any flight it is important to check if a transit visa will be required. As this differs between countries and what passport you are holding it is always best to check with the embassy of the transiting country. For example if you are the holder of a South African passport and are travelling on British Airways to Madrid via London you may require a transit visa.

Cheap-Flight.co.za will endeavour to assist the Client if requested, but such assistance will be at Cheap-Flight.co.za’s discretion (since this service does not fall within the scope of the Services) and the Client acknowledges that in doing so, Cheap-Flight.co.za IS NOT ASSUMING ANY OBLIGATION OR LIABILITY AND THE CLIENT INDEMNIFIES Cheap-Flight.co.za against any consequences of the Client’s failure to comply with any such requirements. It is the CLIENT’S DUTY to familiarize him/herself with the inherent dangers of and mental and/or physical condition required for the proposed travel arrangements.

Access and Use

The Sites are offered to the Client ON CONDITION THAT THE CLIENT ACCEPTS, without modification, the Online Terms. By clicking “continue” on the Passenger information page, prior to any conclusion of any transaction on the Sites, the Client agrees to all the Online Conditions and notices.

Access to and use of the Sites are ENTIRELY AT THE CLIENT’S RISK. Cheap-Flight.co.za may discontinue or suspend the Sites at any time without notice, and it may block, terminate or suspend any Client’s access at any time for any reason in its sole discretion, even if access continues to be allowed to others [provided that such right to block, terminate or suspend any Client’s access is not exercised unfairly on the basis of one or more grounds of unfair discrimination as contemplated in section 9 of the Constitution of the Republic of South Africa, 1996 or Chapter 2 of the Promotion of Equality and Prevention of Unfair Discrimination Act].

Confidentiality

You agree not to disclose Cheap-Flight.co.za Confidential Information without our prior written consent. “Cheap-Flight.co.za Confidential Information” includes: (a) all Cheap-Flight.co.za software, technology and documentation relating to the Services; (b) click-through rates or other statistics relating to Property performance as pertaining to the Services; (c) the existence of, information about, or the terms of, any non-public beta or experimental features in a Service; and (d) any other information made available by Cheap-Flight.co.za that is marked confidential or would normally be considered confidential under the circumstances in which it is presented. Cheap-Flight.co.za Confidential Information does not include information that you already knew prior to your use of the Services, that becomes public through no fault of yours, that was independently developed by you, or that was lawfully given to you by a third party.

No unlawful or prohibited Use

The Client WARRANTS UNCONDITIONALLY that the Client will not use the Sites for any purpose that is unlawful or prohibited by the Online Conditions and notices or any other prohibitions unlawful in terms of South African law.

Links to other Websites

There are links on the Sites which allow a Client to visit the sites of third parties. Neither these sites nor the companies to whom they belong are controlled by Cheap-Flight.co.za and it makes NO REPRESENTATIONS AND GIVES NO WARRANTIES concerning the information provided or made available on such sites nor the quality or acceptability of the products or services offered by any persons or entities referenced in any such sites. Cheap-Flight.co.za’s inclusion of hyperlinks to such websites does NOT IMPLY ANY ENDORSEMENT of the material on such websites or any association with its operators. Cheap-Flight.co.za has not tested and MAKES NO REPRESENTATIONS regarding the correctness, performance or quality of any software found at any such sites. The CLIENT SHOULD RESEARCH AND ASSESS THE RISKS which may be involved in accessing and using any software on the internet before using it. The CLIENT INDEMNIFIES Cheap-Flight.co.za against any claims for loss or damage arising from the Client’s use of or of information gained from or from accessing any such linked sites.

Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, EXCEPT FOR ANY INDEMNIFICATION OBLIGATIONS HEREUNDER OR YOUR BREACH OF ANY INTELLECTUAL PROPERTY RIGHTS, CONFIDENTIALITY OBLIGATIONS, AND/OR PROPRIETARY INTERESTS RELATING TO THE Cheap-Flight.co.zaTERMS, (i) IN NO EVENT SHALL EITHER PARTY BE LIABLE UNDER THE Cheap-Flight.co.zaTERMS FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, EXEMPLARY, OR PUNITIVE DAMAGES WHETHER IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY, AND (ii) EACH PARTY’S AGGREGATE LIABILITY UNDER THE Cheap-Flight.co.zaTERMS IS LIMITED TO THE NET AMOUNT RECEIVED AND RETAINED BY THAT PARTICULAR PARTY IN CONNECTION WITH THESE Cheap-Flight.co.zaTERMS DURING THE THREE MONTH PERIOD IMMEDIATELY PRECEDING THE DATE OF THE CLAIM. Each party acknowledges that the other party has entered into the Cheap-Flight.co.zaTerms relying on the limitations of liability stated herein and that those limitations are an essential basis of the bargain between the parties.

Miscellaneous Entire Agreement; Amendments.

The Cheap-Flight.co.za Terms are our entire agreement relating to your use of the Services and supersede any prior or contemporaneous agreements on that subject. The Cheap-Flight.co.za Terms may be amended (i) in a writing signed by both parties that expressly states that it is amending the Cheap-Flight.co.za Terms, or (ii) as set forth in Section 4, if you keep using the Services after Cheap-Flight.co.za modifies the Cheap-Flight.co.za Terms.

Protection Of Personal Information Act (‘POPIA’)

Operator means an operator as defined in the Protection of Personal Information Act, 4 of 2013; Personal Information means personal information as defined in the Protection of Personal Information Act, 4 of 2013;

Protection of Personal Information

You hereby authorise Cheap-Flight.co.za, to collect your Personal Information as it is relevant to this Agreement and/or service which we are providing for you or is deemed to be relevant for the provision of such service.
Cheap-Flight.co.za is committed to the adherence of national legislation and regulations pertaining to the safeguarding of data privacy.
Cheap-Flight.co.za shall use information previously provided by you to perform our services and to amongst other things, process invoices, credit notes, statements and any other document related to the services.
You confirm that we may share your personal information with the following persons, who have an obligation to keep the personal information secure and confidential:
Employees of Cheap-Flight.co.za who are required to be informed of the personal information in order to attend to the services supplied and;
Cheap-Flight.co.za may be required to share/transfer/store (“process”) personal information with either Third Parties and/or Principals, in order to supply the services to you (which may include sharing or personal information outside South Africa). Should Cheap-Flight.co.za process any personal information outside South Africa, we shall ensure that such jurisdiction has data protection legislation that is of the same or higher standard to that required by POPIA or in the absence of such data protection legislation, contractual terms will be agreed to between Cheap-Flight.co.za and such third party and/or Principal to ensure protection of any personal information shared with Cheap-Flight.co.za to the same or higher standard as required by POPIA.
We undertake not to disclose your personal information unless it is legally or contractually required to do so.
We agree to use all reasonable efforts to ensure your personal information in our possession is kept confidential, stored in a secure manner and processed in terms of POPIA.
You hereby acknowledge and warrant that:
Cheap-Flight.co.za is entitled to process and store any such Personal Information in the manner set out in Cheap-Flight.co.za’s Privacy Policy, available on the website https://www.Cheap-Flight.co.za.co.za/privacy;
Cheap-Flight.co.za is entitled and authorised by you to transfer any Personal Information to any of its Operators; and
Cheap-Flight.co.za is entitled to store and back-up your Personal Information on its servers. You confirm that you have read and agree to Cheap-Flight.co.za’s Privacy Policy and hereby provide your consent to Cheap-Flight.co.za to process your personal information and acknowledge that you understand the purpose for which it is required and for which it will be used.

Assignment.

You may not assign or transfer any of your rights under the Cheap-Flight.co.za Terms.

Independent Contractors.

The parties are independent contractors and the 12, the Cheap-Flight.co.za Terms do not create an agency, partnership, or joint venture.

No Third-Party Beneficiaries.

Other than as set forth in Section 12, the Cheap-Flight.co.za Terms do not create any third-party beneficiary rights.

No Waiver.

The failure of either party to enforce any provision of the Cheap-Flight.co.za Terms will not constitute a waiver.

Severability.

If it turns out that a particular term of the Cheap-Flight.co.za Terms is not enforceable, the balance of the Cheap-Flight.co.za Terms will remain in full force and effect.

Entire Contract

All the terms and conditions displayed on the Sites constitute the entire terms of the relationship between the parties. There exist no other terms, conditions, warranties, representations, guarantees, promises, undertaking or inducements of any nature whatsoever (whether verbal, written or electronic) regulating the relationship and the CLIENT ACKNOWLEDGES that he/she has not relied on any matter or thing stated on behalf of Cheap-Flight.co.za or otherwise that is not included herein.
